Daniel, Kevin and Amber share morning coffee and complaints about their lives, wonder what happened to "their" money.
Cane and Lily, in the break room at NE, share their lack of forgiveness for their respective spouses, say each should have followed their instincts.
Michael tells Phyllis that there's an incriminating tape of Phyllis and Brad that David Chow gave to the prosecution. Michael asks Phyllis what's on it - worse case scenario is that it's about her telling Brad that she spoke to the room service waiter and if he didn't vote her way, she'd tell Brad's wife of the affair.
Victor thanks Cane for the revised figures for Clear Springs, and in walks Lily again (break room). His phone rings and he ignores it (Amber called). They speculate about whether Daneil and Amber slept together. Now Lily's phone - Daniel, and she ignores it, too. Both Amber and Daniel leave messages, please, please call back. Now Kevin's home line rings and Amber answers - it's Jana, asking for Kevin - he hangs up..
Victor informs Niki that he's called a meeting to clean up the messes he, Brad, made.
Heather presents the tape, judge questions the chain of custody, Michael asks that the evidence be discluded, judge says "play the tape". Oops, it's Phyllis telling Brad about her conversation with Carlos, the room service waiter, and that she overheard Brad and Sharon discussing their night together. Judge will allow the tape if custody can be established.
Kevin calls cops to ask they make Jana stop calling him and his friends.
Victor, Neil and Brad are in a meeting. V says all this bad publicity is damaging to his company, Brad points out that this publicity is Niki's fault - she was the one that dragged the NYC thing up.
David Chow testifies about the chain of custody of the tape. Michael objects, judge says it's admissible, but feel free to appeal. Phyllis glowers.
Everyone watches the tape, including Nick and Daniel. Michael asks for a recess to speak with his client. He tells Phyllis she has to testify that she didn't mean what she said on that tape. Nick isn't impressed.
Kevin gets a call from a nurse at the hospital - Jana has had a severe convulsion and may have a skull fracture. Kevin says call somebody who cares.
More Cane and Lily as he helps her bring more clothes back to her dad's. Lily talks about how Phyllis was the cause of her mother's death, and Cane holds her in his arms for comfort.
Victor takes Brad off the sugar cane project because people don't trust him now. Devon enters, Victor compliments him on his work, then awards the Brazil project to him. Brad's royally pissed. Neil says that Devon's good work would have been recognised whether or not he was his son.
Phyllis is called to the witness stand. Michael questions her about the board positon that had opened up and why she and her husband wanted Neil in the position rather than Niki. She pulled that one off pretty well by saying her "threat" to Brad was all hot air, and NO, she did not tell her sister-in-law about the affair, not one word. Brad's marriage fell apart and instead of taking responsiibilty for it, he's trying to blame someone else.
Scene with Victor and Neil as V says he didn't give Devon the project as a favour to Neil, it was a sound business decision.
Niki and David gloat about the tape, Niki is "summoned" to the office by presumablt Victor.
Kevin and Amber take off for the hospital.
Heather cross-examines Phyllis and brings up Phyllis' escapades in the past. Michael vehemently objects. (Heather's coming off as a self-righteous witch here.)
Niki's pissed that Victor had a background check on David. He points out that David's had 3 wealthy ex-wives and he's likely going to try to make her the fourth. Niki says he (V) makes her sick, he agrees it's mutual, lol.
Jana's so pleased to see Kevin, but not Amber. Nurse tells Kevin that the state funding for Jana's surgery hasn't been approved yet.
Phyllis tells Nick she didn't think she should have taken the stand. Nick's puzzled as she tells him that she had already told him ablout her past and he forgave her. Does he remember that? Nick flinches.
More Cane and Lily hanging out deleting their phone messages. They agree to keep in touch, create their "Spouses Anonymous" programme.
Heather addresses the jury, blah, blah. Daniel, Michael, Lauren sit quietly listening.
David bursts into Victor's office saying somebody just ran him off the road. Victor yells that if he wanted him dead, he WOULD be dead, now get the hell outta here.
Michael's turn to address the jury, makes a good argument.
