he keeps saying he's going to use the rape as evidence that luke shouldn't have contact w/laura. one big problem w/that. luke was never arrested, tried or convicted. this would make all mention of the rape inadmissible. of course TPTB will totally ignore this little detail.

This isn't a criminal trial. It's a family court. They don't have to prove anything occurred, just that there was enough to prove a strong accusation. Just like Rick got his daughter Molly despite doing the horizontal mambo with Sam. Family court rules are vastly different.
