Phyllis hands Nick the custody papers for Summer, divorce papers if she gets the maximum and he tears them up. He's not going to divorce her based on the outcome, then plants a nice big kiss on her, says "take that to court with you".
Sharon tells Jack she isn't going to go to the sentencing. Jack assures her she isn't to blame for whatever happens to Phyllis, phone rings and it's Phyllis asking him to come to court today for support and he agrees. Sharon sort of agrees it's okay.
Nick's holding Summer, Michael comes in to take Phyllis to court, Lauren, too. Michael counsels Phyllis to have two faces - stoic and remorseful, and don't smile as the judge will see that as a lack of contrition.
Nick tells Lauren that he's going to respect Phyllis's wishes and stay away from court today. He goes on to say that he wishes he could remember better that Phyllis is actually a really good person. Lauren assures him that she is.
Neil asks Sharon if she'd like to walk over to the court with him - nope she isn't going. He starts a bit of a rant, guilt trips her a little, then leaves and rides down the elevator at NE with Daniel, sneers at him.
Daniel, on the phone with his mom, says he's on his way. Brad turns up outside the courtroom, snarking, smug to Phyllis. (You just KNOW he's going to get his comeuppance with that attitude, lol.) Phyllis calls him a pathological liar, who is he to berate her mothering skills.
Brad's on the witness stand, calls Phyllis a menace to society, says Phyllis went out of her way to destroy his marriage, not out of human emotion but out of the desire to get ahead in business, and that's not just playing hardball, it's just EVIL. (gag)
Niki's on the stand, calls Phyllis a curse, made any attempt at reconcilliation between her daughter and Brad impossible, then goes on to say she lost her seat on NE board because of Phyllis, could go on and on, then flounces off. Neil's turn on the stand.
He says there will always be a question about whether or not he deserved that seat on the board, and does Phyllis understand what that means....then says Phyllis is responsible for his wife's death. Judge tells him that accusation is inappropriate.
Heather calls Lily Winters, Michael objects, judge allows it. Lily enters, takes the stand. Judge asks Lily if she understands that there was no criminal intent involved in her mother's death, she says there was a connection, then reads a little blurb she wrote about Phyllis and her connection to Dru's death, and it goes on and on - victim impact crap, how they'll never forgive Phyllis. Meanwhile, back at Jack's house, Sharon explains Phyllis's situation to Noah.
Daniel's on the stand, reads glowing words about his mother. Niki smirks (what a royal witch), Phyllis chokes up a bit. Phyllis hears Summer crying outside, stands up, Lauren runs out and holds Summer so Nick can go inside to speak up for Phyllis. Judge invites him to come forward. (The surprise witness!!) He remembered something, an incident before the accident involving Phyllis and a bunch of punks that were picking on someone, and she handled them so well - she's a good woman and he's proud to call her his wife. Michael asks for a recess as Phyllis is all teary, and he gives them 15 minutes.
Neil invites his 2 kids out for an expensive lunch, Lily wants to stay for the sentencing. The guys will stay with her. She's fixated on Phyllis's part in her mother's death. )
Hmmm - Daniel's really bugging me with his big grinning face. Looks goony. I used to like him.
Scene with Niki, Victoria, Nick and then Brad - Brad swaggering, Nick putting him down, Victoria looking like an idiot. Brad swaggers off back into the courtroom.
Noah and Sharon again, this time at CL. She's yet again explaining life and the legal system to Noah.
Phyllis is on the stand - all contrite and remorseful, needs to apologise to the people she hurt, and to Daniel for having to go through this. She apologises to Niki, who sits there looking old and grim, then to Victoria, sorry she humiliated her in public over a piece of real estate. Then she apologises to the 3 Winters about Drucilla's death, and it haunts her. Neil tears up, so does Phyllis. She tells judge she's guilty, should go to jail, but please don't punish her daughter, please, please take her daughter into account. Sob, sob, sniff.
Sharon appears in court at the last moment. Judge allows her to take the stand, but it's her son that wants to speak. Kid states Phyllis is really nice to him, she helps him with his math homework, gives him $5 to give to the homeless guy at the ice cream stop. Judge asks if he can take Noah's long list with him to read in his chambers, then Sharon asks to take the stand. She says she doesn't think Phyllis did what she did out of malice, just bad judgement. And she's a good mother and step-mpther. Brad squints at her, lol. Sharon speaks well of Phyllis and makes a case for keeping Phyllis out of prison. Judge thanks everyone and goes off to make his decision.
